Announcement on the Conclusions of Viscofan USA Investigation

​Further to our communication of October 15, 2025 to the CNMV(registration number 37193), Viscofan provides the following additional information regarding our manufacturing facility in Danville, Illinois.

Regulatory Environment and Compliance

Viscofan's U.S. operations are subject to stringent environmental, health, and safety requirements. The Danville facility maintains multiple permits under the Clean Air Act and Clean Water Act, which impose rigorous monitoring and reporting requirements. We work with the Illinois Environmental Protection Agency (IEPA) and the U.S. Environmental Protection Agency (EPA), which oversee compliance through a highly structured process. When potential violations are identified, the IEPA typically issues a Violation Notice requesting corrective measures. Facilities address these through Compliance Commitment Agreements, and most matters are resolved administratively without legal action—which is standard practice for U.S. manufacturing facilities.

Compliance Record

Since 2020, Viscofan USA Inc. has received certain Violation Notices from the EPA and IEPA alleging isolated instances of non-compliance—as is common for manufacturing facilities of our scale and complexity. All matters have been satisfactorily resolved or are pending final resolution with no material impacts. No legal action has been filed alleging negative impacts on health or the environment.

The facility has addressed three air emission matters, two waste management matters, and one water discharge reporting delay. No fines were imposed, and corrective actions were implemented within ordinary operating budgets. The most recent air compliance matter is listed on the IEPA website as "Non Violation Identified" as of October 24, 2024.

Safety Excellence

Our Danville facility holds ISO 45001 certification and maintains a severity index of 0.06, well below industry average. Over five years, OSHA fines totaled $185,530 for a facility employing an average of 300 workers in 24/7 operations. Viscofan works under the premise that every accident should be preventable and the security ratios related incidents are in line with industry standards for a facility of our size and scope, demonstrating our strong commitment to workplace safety.   

Response to Misleading Health Risk Claims

On October 14, 2025, Hunterbrook Media LLC (“Hunterbrook”) published a report making serious allegations about health and environmental impacts at our Danville facility. It is important to understand the source and nature of these claims.

Hunterbrook is not a traditional news organization. It is an investment fund that produces reports and partners with legal advisors specializing in individual and class action lawsuits as part of an investment strategy.  

Hunterbrook's claims regarding health risks at our Danville facility are particularly misleading.  According to publicly available data on the IEPA website, the Danville facility has an RSEI Hazard Score of 0 in the carcinogenic category and a moderate score for non-carcinogenic substances. Hunterbrook's allegations of cause-and-effect relationships between the facility and health conditions lack any scientific or medical evidentiary basis and are based on anonymous, unverified testimonies.   

Continuous Improvement Initiatives

As part of our commitment to operational excellence, Viscofan has engaged Baker McKenzie LLP as legal counsel along with other environmental and technical advisors working at Baker McKenzie’s direction to conduct a systemic review of our environmental, health, and safety operations. This review encompasses all aspects of our health, safety, and environmental programs and processes at the Danville facility. 

The goal of this initiative is to continue ensuring that we maintain excellent standards across all areas of our operations, meet or exceed all regulatory requirements, and implement industry-leading best practices in environmental stewardship and workplace safety. Based in our continuous improvement business model we have implemented or are implementing enhanced measures across multiple areas being the most relevant in environmental and health and safety areas:

  Air emissions. Upgrading monitoring equipment; enhancing scrubber system maintenance, calibration, and alarms; strengthened emergency procedures.

Waste management. Improved hazardous waste area management; enhanced labeling and documentation.

Workplace safety. Comprehensive personal protective equipment assessments and reinforced safety training and monitoring systems; additional physical barriers.

Compliance systems. Enhanced monitoring and reporting procedures and enhanced employee training.

 These initiatives are implemented in accordance with industry best practices.  Viscofan remains committed to transparency, regulatory compliance, environmental stewardship, and the health and safety of our employees and community.
